Terms of Use and License Agreement
Introduction
Western Canada Lottery Corporation ("WCLC") is authorized to manage and conduct lotteries within the territorial limits of the Provinces of Alberta, Saskatchewan and Manitoba, and the Yukon Territory, Northwest Territories and Nunavut (the "Authorized Jurisdictions").
By downloading and using this this mobile app of WCLC (the “Application”), you confirm and agree that you are subject to the conditions and restrictions outlined below (the “Agreement”):
Information
Although reasonable effort is made to ensure its accuracy, the information on this Application, including but not limited to the winning numbers, jackpot amounts and store locations is not official and may contain inaccuracies or typographical errors. Information may be changed or updated without notice. WCLC may also make improvements or changes in the products, and the games described in this Application at any time without notice.
License to Use: This Application is owned by WCLC and is licensed, not sold to you. You are hereby granted a personal, limited, non-exclusive, non-transferable, non-assignable license to use the Application only on devices that you own or control (‘Device’). You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not use this Application if you are under the age of 18. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application or any part thereof. You may not lease, transfer, lend, sublicense , sell, disseminate, broadcast, transmit, or otherwise distribute the Application in any form or by any means, or otherwise transfer, assign, manipulate, or grant any rights of use or any other rights in respect of the Application, or any part thereof, or the information contained therein, to any other party. You must delete the Application from your Device before you sell or otherwise transfer your Device. Except for the limited license to use granted herein, you are granted no other rights with respect to the Application and all other rights in the Application are reserved for WCLC’s use or other disposition.
Changes to Agreement: WCLC may, in its sole discretion, change, modify or amend this Agreement from time to time, for any reason and without prior notice or liability to you or any other party. When this Agreement is changed, modified and/or amended, the revised Agreement will be accessible on the Application. The use of the Application after such changes, modifications or amendments are accessible will signify your acceptance of those revised terms. You are responsible for periodically viewing this Agreement to review the applicable terms and conditions. This Agreement and the license to use granted hereunder will apply to any upgrades provided by WCLC that replace and/or supplement the original Application, unless such upgrade is accompanied by a separate license in which case the terms of that license will be applicable.
Third Party Services: The Application may enable access to WCLC’s and/or third parties’ web sites and services. Use of these services may require Internet access and that you accept additional terms of service.
Eligibility: By downloading the Application, you confirm to WCLC that you are aged 18 years or older.
Termination: Your rights under the Agreement to use the Application will terminate automatically without notice from WCLC if you fail to comply with any term(s) of this Agreement. Upon such termination you shall cease all use of the Application, and destroy all copies, full or partial, of the Application.
Copyright, Trademark and Intellectual Property Information
This Application may contain other proprietary notices and copyright information, the terms of which must be observed and followed. Lottery trademarks and logos used on this Application are either licensed to or the property of WCLC. Their use by others is not authorized and no logo, graphic, sound or image from this Application may be copied or re-transmitted unless expressly permitted by WCLC. Unless otherwise specified, no one has the permission to copy, redistribute, reproduce, republish, store in any medium, re-transmit, modify, exploit or make public or commercial use of, in any form, the information contained on this Application.
Sale of Lottery Tickets
WCLC maintains this Application as an information service to its legitimate customers within the Authorized Jurisdictions. WCLC does not sell or authorize the sale of lotteries outside the Authorized Jurisdictions. Nothing in this Application is intended to promote, advertise or publish lotteries or other gaming outside of the Authorized Jurisdictions. With the exception of subscriptions for Saskatchewan, Manitoba, Yukon, Northwest Territories and Nunavut through the WCLC and Sask Lotteries websites, WCLC does not sell any lottery tickets on the Internet and no one is authorized or endorsed by WCLC to sell lottery tickets on the Internet. WCLC does not authorize the sale of lottery tickets to minors or the cashing of tickets by minors.
Disclaimers
This Application and all information on this Application is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title or non-infringement. Anyone downloading files does so at their own risk and assumes the risk of computer viruses or other malicious programs.
In no event will WCLC, its directors, officers, employees, agents or content providers be liable, whether in contract, tort or otherwise, to any party for any direct, special, indirect, consequential, or any other losses or damages of whatever nature, including without limitation, any damages for lost profits, business interruption, loss of programs or other data, arising in any manner from (i) the use of this Application, whether directly or through a hyperlinked site, (ii) the use of any other website or Application linked to this Application by hyperlink or otherwise, (iii) modification or discontinuance of all or part of this Application, (iv) any errors, omissions, inaccuracies, or any misleading or out-of-date information, whether contained on this Application or as received by the user of this Application or (v) resulting from any harmful programming code that could install itself on the Application or be transmitted via the Application, even if WCLC, its directors, officers, employees or agents were aware or should have been aware that such loss or damage could occur. In the event of any discrepancy between information provided by the Application and the official information of WCLC, the latter shall prevail.

This Application may contain links to websites or mobile apps maintained by third parties. The linked sites or apps are not under the control of WCLC, and WCLC is not responsible for the contents of, or the privacy practices of, any linked site or apps or any link contained in a linked site or app. WCLC provides these links only as a convenience, and the inclusion of a link does not imply endorsement of the linked site or app by WCLC.
Links from Third-party Sites or Mobile Apps
WCLC cannot control which websites or apps link to this Application. No such link should be construed as an endorsement by WCLC of any such third-party site or app.
Unsolicited Proposals and Information
WCLC does not solicit, request or want to receive proposals, or any confidential or proprietary information from users of our Application. Unless WCLC has first signed a written confidentiality agreement, any unsolicited proposals, information or material sent to WCLC will be deemed not to be confidential and WCLC will have an unrestricted, irrevocable license, without fee, to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that WCLC is free to use any ideas, concepts, know-how or techniques that you send us for any purpose.
Without limiting the generality of the foregoing, please note that WCLC has an internal Marketing Department that is exclusively responsible for the development and marketing of its gaming products. Therefore WCLC has a rigid policy of not discussing or entertaining any discussion or unsolicited proposals concerning game development or marketing from third parties. Accordingly, you should not convey or attempt to convey any unsolicited proposals to WCLC with any expectation of compensation or commitment. Because of the many legal implications (to both WCLC and potential suppliers), WCLC cannot authorize, support, endorse or associate with any third-party venture, scheme or promotion.
Applicable Law
This Agreement and your use of this Application will be governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, but expressly excluding any conflict of law rules which would lead to the application of the law of any other jurisdiction. You agree that any dispute must be resolved before the Courts of the Province of Manitoba, and you hereby irrevocably attorn to the exclusive jurisdiction of those Courts.
Official Game Conditions, Rules and Regulations and Other Information
Official Game Conditions, Prize Structure Statements, official lists of winning numbers, results, odds and prize breakdowns, and the Rules and Regulations Respecting Lotteries and Gaming of WCLC and, where applicable, Interprovincial Lottery Corporation ("ILC"), supersede any information on this Application. These are available from WCLC and in some cases through its authorized retailers. They may be changed from time to time by WCLC or ILC as applicable.
Privacy
Mobile app users can use the app without telling us who they are or revealing any personal information about themselves. WCLC does not collect information through its website or mobile app that personally identifies individuals except when individuals provide such specific information voluntarily by e-mail, by participating in a survey or contest or by requesting a particular product or service from WCLC. With respect to e-mail, WCLC may collect, retain and use such information in the same manner as it does other correspondence sent to WCLC. With respect to personal information provided by participating in a survey or contest or by requesting a particular product or service from WCLC, the purpose for the collection of the personal information and how such information will be used will be identified at the time the information is provided. Unless it is permitted or required to do so by law, any such personal information about individual users will not be transferred by WCLC to unaffiliated third parties without the approval of the user. WCLC does not sell any personal information that it collects to any third party and does not share or transfer personal information that it collects to unaffiliated third parties for their own marketing efforts.
This Application uses Google Analytics, an analytics service provided by Google, Inc. ('Google'). Google Analytics uses binary files placed on your device to help the application analyze how users use the application. This information, including anonymous location information, will be used for the purpose of evaluating your use of the application, compiling reports on application activity for application publishers and providing other services relating to application activity. The information generated by Google analytics regarding your use of the application may be transmitted to and stored by Google Analytics on servers in the United States. For more information on Google Analytics privacy policy, visit http://www.google.com/analytics/. By using this application, you expressly consent to the collection, processing and use of data about you by Google and WCLC in the manner and for the purposes set out above. WCLC will not seek to match IP addresses or device id to identifiable individuals, unless we are required by law to do so or we are investigating detected or suspected security breaches or other illegal behaviour, and we need to do so in order to carry out the investigation. In addition, your Device ID is recorded and stored when you request to receive notifications. This information in no way identifies you personally.
The user's location will be used when they access the Find a Store section of the application. However before the app can use this function, the phone’s operating system will ask if the user wants to allow the application to use Location Services before the application will be allowed to access this information. The location used by Find a Store will not be retained by the app.
With respect to communicating with us over the Internet, although WCLC takes steps to prevent unauthorized access to the information maintained by WCLC please note that Internet communications are not absolutely secure and accordingly we cannot guarantee that the information you send to us will not be intercepted, collected and misused by others without your consent.

This mobile app’s privacy policy is an implementation of, and is subject to, WCLC's general privacy policy. A copy of WCLC's general privacy policy can be obtained by contacting WCLC at privacyofficer@wclc.com.
General
This Agreement constitutes the complete and entire agreement between you and WCLC with respect to your use of this Application and its content and supersedes all prior agreements, whether written, oral or otherwise, between you and WCLC with respect to your use of the Application and its content.
If any portion of this Agreement is held to be invalid under any applicable rule of law, then such provision will not apply and such invalidity will not affect other provisions hereof which can be given effect without the invalid provisions, and to this end, the affected provisions hereof are declared to be severable. The foregoing notwithstanding, such invalid provision will be construed and enforced (to the fullest extent permissible under applicable law) in accordance with the original intent as herein expressed.
